法律关系要素的内涵改良探讨——兼论后代人利益的保护

对“法律关系”这类接近法律体系逻辑起点的法学基石性范畴的要素内涵做符合时代要求的改良性理解 ,会起到牵一发而动全身的效果 ,有助于可持续发展型法律体系的稳步形成和发展。就主体而言 ,应充分认识主体“人”的共时性、历时性、复杂性、多态性以及后代人的相对性和客观必然存在性。就客体而言 ,加强对物的生态价值的认识和保护 ,强化行为的正生态意义。就内容而言 ,在注意后代人特殊性的前提下 ,探讨了如何保护后代人的利益。如果本文部分观点被认为是正确的 ,并对《法理学》这类基础课程中的法律关系要素内涵有所改良 ,将是很有意义的

On the Connotative Improvement of the Factors of Legal Relation——Discussing the Protection of Descendant Benefit Simultaneously

It will reach a domino result to timely and amelioratively understand'legal relation,i.e. a concept referring to the essential connotation of basic legal category near the logic starting point of legal system.This is helpful to the steady formation and development of sustainablly developing legal system.As far as the subjectives is concerned,we should fully understand its,i.e.man's synchroism,dischronism,complexity and understand the relative nature and the o bjective inevliable existence nature of the descendant. As far as the objective part is concerned,we should strengthen the understanding and protection of the ecological value of things and consolidate the positive ecological meaning of actions.As far as the content is concerned,on the premise of noticing the specifi charateristics of the descendant,how to protect their benefit is investigated.The author would think it very significant if some viewpoints mentioned in this paper are considered as right and helpful to the amelioration of some essential connotations of legal relation in such foundational course as 'jurisprudence'.
