| 摘 要： | 行政执法与刑事司法的有效衔接，对防治违法犯罪行为具有重要的实践意义。制约两法衔接机制有效发挥的问题主要存在于制度执行、信息共享、考核强化等方面。应从畅通两法衔接渠道、提升两法衔接能力、完善两法衔接懈怠等三个方面着手予以解决。

| Abstract: | Effective linkage between administrative enforcement and criminal justice, has important pracueat significance on the prevention of crime. After theoretically analyzing the relevant data and typical case of the administrative enforcement and criminal justice, we find that the problems that restrict the effectiveness of the convergence mechanism of the administrative enforcement and criminal justice, mainly exist in the implementation of the system, information sharing and strengthening assessment. We should solve the problems from opening the channels of converging the two laws, enhancing the cohesion of the two laws and perfecting the cohesion slack of the two laws. |
