| 摘 要： | 5040是柏拉图在《法律篇》中为他设计的名为“马格尼西亚”的次级理想国的公民总数和土地份数。5040问题之所以成为古希腊哲学乃至人类文明史上一大问题,不仅在于它是一个纯粹的数学问题,更在于它是一个数理化了的法律问题与哲学问题。柏拉图通过运用逻辑的手段对5040这一数字进行解构,由此演化出现今意义上的不动产分配法、计划生育(人口控制)法、殖民理论与诚信观念等,并揭示出了其中蕴涵的数理、法理与哲理。基于此,对5040问题的研究便成了从侧面理解古希腊哲学和洞察西方法律源流的一把钥匙。

| Abstract: | The author holds that the question of 5040,a.s proposed by Plato to designate the population and shares of land in his idealized republic,is not only a mathematical one,but a philosophical and legal one as well.All other concepts related to it,from the distribution of land property,through birth control,to colonialism and credit,are offspring from it.The present paper attempts to investigate the legal aspect of the question. |
