| 摘 要： | 随着经济的日益发展，著作权经济价值不断增加，而侵犯著作权的犯罪所造成的危害也日益严重，加强著作权的刑法保护已成为当今世界各国的著作权保护的立法趋势。资格刑通过剥夺行为人实施某种行为的资格和能力，最终达到实现刑罚特殊预防目的的独特功能。在单位犯罪、高技术犯罪日益突出的今天，引进并适用著作权刑法保护中的资格刑，主要是限制侵犯著作权犯罪中的单位或直接责任人员，防止其利用从业条件再实施同类犯罪。
