| 摘 要： | 通过对正当防卫传统理论和立法方面在现实与逻辑上的错误的讨论,提出在家庭暴力犯罪中,主观意图不是构成正当防卫的必要条件,对相应不法侵害的临界时间应当辩证理解,防卫适当的认定标准应当科学界定.最后提出立法建议.

| Abstract: | By discussing the traditional theory of legitimate defense and the mistakes in the law making in terms of facts and logic, we reach the conclusion that in the crime of domestic violence, subjective intention is not the prerequisite of legitimate defense. The critical point of unlawful infringement should be viewed dialectically and the criterion of appropriacy indentification of defense should be made scientifically. Finally, some advices for law making are proposed. |
