摘    要:《物权法》对于区分所有建筑物共用部分的概念、范围缺乏明确规定,使得实践中大量的共有权纠纷未能得到有效解决。综合考察各国关于共用部分的立法模式,指出中国应采取排除式、列举式和推定式相结合的立法模式,专有部分的确定不应以“能够登记”为要件,建筑区划内专门服务于业主、专供业主使用的公共场所才是共用部分,供水、供电、供气等专营供用设施归属亍专营供用企业为宜。
