| 摘 要： | 1987年6月29日国务院发布的《医疗事故处理办法》,对于妥善处理医疗事故、保障医患双方的合法权益起到了很大的作用,但也有其历史局限性。2002年4月4日国务院颁布了《医疗事故处理条例》则摒弃了《办法》不能适应新形势的“窠臼”,给医疗事故处理注入了一种全新的理念和运作方式。笔者将《条例》与《办法》进行比较分析,解读出《条例》有比《办法》更新的特点和变化。

| Abstract: | Measures for Settling Medical Malpractice Cases"issued by the State Council on June 29,1987plays a very important role in appropriately handling medical m alpractice and protecting the legic imate rights and interests of doctors and patients.But there are some historic limitations to this legal document."Regulations for Settling Medical Ma lpractice Cases",which was issued on April 4,2002,has a completely new idea and way of settling medical malpractice.This paper i s a comparative study of the two legal documents. |
