国际体育仲裁中的第三方问题

在国际体育仲裁中,有关仲裁第三方参加仲裁以及仲裁效力如何及于第三方的规则并不是十分明确。而由于体育仲裁所特有的强制性特点,仲裁裁决对第三方的影响是显而易见的。国际体育仲裁对裁决效力如何及于第三方也进行了一定的实践,仲裁协议的强制性以及仲裁庭程序上的自主性成为裁决效力及于第三方的法律基础,“一事不再理”的原则也多基于此,从而在体育仲裁中得到运用。国际体育仲裁院(CAS)需对仲裁实践进行总结,并制定出更加明晰的有关第三方参加仲裁的规则。而对国际体育仲裁有关第三方问题的实践的分析和把握,对如何应对可能对我国运动员或运动组织产生影响的仲裁,也有积极意义。

Problems Concerning the Affected Party in International Arbitration of Sports

In the international arbitration of sports,the rules are not explicit concerning the arbitration of participation by the affected party and the arbitration impact on the affected party.However,the award of arbitration has a deep impact on the affected party on the basis of the compulsory sports arbitration.In addition,the compulsory arbitration agreement and the independence of arbitration procedure are the bases of the validity of the affected parties in arbitration,and the principle of "against double jeopardy" is employed in sports arbitration.In this case,CAS should have a study of the problems of the affected parties raised in the past cases of the sports arbitration,and then enact the rules of the arbitration of participation by the affected party.Meanwhile,the study of the rules concerning the affected party in the international arbitration of sports is helpful for us to solve the problems concerning Chinese athletes in the international arbitration of sports.
