| 摘 要： | 按照动产物权变动原则,对中国《物权法》第24条进行解释,结果表明：特殊动产的物权变动应以交付为生效要件,但法律另有规定或法律允许当事人约定不以交付为生效要件的除外,登记仅是该特殊动产的物权变动可对抗善意第三人的要件。

| Abstract: | Interpretation in Article 24 of Law of the People’s Republic of China on Real Right was put according to rule of changes of chattel’s rights,which indicates that creation and transfer of rights on special-movable property are taking effect through delivery except that law regulates expressly escapable clauses or law permits parties could make an arrangement that creation and transfer of rights aren’t taking effect through delivery.And the creation and transfer of rights on special-movable property could resist to the third person in good faith only through registration which is the key factor. |
