| 摘 要： | 先决问题的构成要件应重新审视,主要问题依法院地国的冲突规范必须以外国法作为准据法不应是先决问题的必备要件。先决问题的准据法,应结合具体案件具体分析。将先决问题用分割方法解决或认为先决问题不如识别问题重要的做法并不恰当。

| Abstract: | Requirements of preliminary question should be re-considered.That the main issue should be governed by a foreign law shall not be a necessary element of preliminary question.The applicable law of preliminary question should depend on the nature of the individual case.It is not proper to put preliminary question at the level of depecage or argue preliminary question not as important as qualification. |
