| 摘 要： | 督促程序是商品经济的产物，然而，在我国市场经济快速发展的今天，督促程序却倍受冷落，形同虚设。督促程序在我国存或废的问题，值得我们思考。本文从督促程序在我国的运行环境和理论基础进行反思，认为督促程序在我国有继续存在的必要性。并提出从督促程序自身及相关司法制度上寻求完善．以克服督促程序设计的缺漏使之适应我国的国情，才是督促程序的出路所在。

| Abstract: | The supervising and urging procedure is the result of the commodity economy. However, the supervising and urging procedure has been ignored nowadays though the marketing economy in our country is developing rapidly. It is worth contemplating whether the supervising and urging procedure should exist in China. The article discusses the supervising and urging procedure from the practical environment and the theory basis, and draws the conclusion that it is necessary for the supervising and urging procedure to exist continuously in China. Furthermore, the supervising and urging procedure should be perfected in itself and related judicial system so that it can overcome the shortcomings in design and adapt to the conditions of our country. |
