程序公正追求中的困境与出路——以一件典型性纠纷案件为例的思考

司法公正包含程序公正和实质公正。通过对一件典型案件的剖析,文章揭示了程序公正在中国当代社会转型时期遭遇的困境:不能有效回应当事人对大众正义的诉求,扩大了社会资源的成本付出,并且对社会弱势者产生不利的诉讼影响。解决困境的出路应当在追求程序公正中兼顾实质公正。

Dilemma and Outlet of Procedural Fairness in the Pursuit

Justice contains the procedural fairness and substantive fairness. With a typical case, this article reveals the hardship suffered by the procedural fairness in the Chinese social transformation period. It includes the weak response to litigants of the demand of public, the increase of cost of social resources, and the adverse impact to the vulnerable groups with the outcome of proceeding. The way to solve these problems is to take care of the substantive fairness in the pursuit of procedural fairness.
