浅析环境问题的民法应对

随着人类生存环境的日益恶化,环境问题受到越来越多的关注。环境问题的产生,既要考虑自然因素,也要考虑人为因素,而法律制度尤其是民法制度更要引起重视。我国传统民法在环境理念、权利、制度、原则等方面存在一些缺陷,需进一步改进,才能适应现代化社会的生态环境保护需要,促进社会可持续发展。本文将对当前环境问题中民法弱化的原因进行分析,并有针对性地提出环境问题的民法应对策略以及未来发展。

Settlement of Environmental Issues in Accordance with Civil Law

With the increasing deterioration of the human environment,environmental issues are more and more serious.Environmental problems originate from both the natural and human factors.Meanwhile,greater importance must be attached to legal system,especially the civil law system.China′s traditional concept of civil law is expected to be improved due to the defects concerning the idea,rights,institutions,and principles of environment,so as to meet the needs of ecological environment in modern society and to promote sustainable social development.This paper will study the causes of the weakened the civil law considering environmental issues and put forward the strategies for the settlement of environmental problems in accordance with civil law.
