| 摘 要： | 目前我国贷款诈骗犯罪形势日益严峻,成为经济领域中常见、多发的社会危害非常严重的犯罪。笔者针对司法认定中的诸多疑难问题,如贷款诈骗罪的对象范围、单位贷款诈骗、贷款诈骗客观行为、主观上非法占有目的以及贷款诈骗数额进行了分析和探讨,并提出了相应的立法和司法建议。

| Abstract: | Presently fraud crime of loan is serious in China,and fraud crime of loan has become one kind of crime which is common,frequent with bad social effect in economic field in this country. The author probes into those problems such as the scope of object of crime, the subjective act, the purpose of illegal possession and the amount of the crime,and proposes suggestions in criminal legislation and administration of justice. |
