| 摘 要： | 纪元前167年,西汉孝文帝将"断肢体"的劓刑和刖刑,"刻肌肤"的黥刑"易"之为劳役刑、笞刑和生命刑.关于这一事件,两千多年来争论一直未停止.本文就其中的焦点问题提出了自己意见,认为汉初内刑有三种,汉初存在宫刑;汉文帝并未废除宫刑.

| Abstract: | In 167B.C. the Xiaowen Emperor of Xihan Dynasty changed the punishments of cutting off the nose or the feet and that of branding the face into penal servitude, whipping, and death penalty. However, there has been great controversy towards this issue for more than two thousand years. This article puts forward the author's own opinion towards the key problem by maintaining that there were three main kinds of corporal punishments in Han dynasty. Castration existed in early Han Dynasty and Wen Emperor didn't abolish it yet. |
