| 摘 要： | 廓清立法解释程序的内容与范围,是研究与完善立法解释程序的前提,同时其本身也是立法解释程序的基本问题之一.对立法解释程序内容与范围的界定,应当从立法解释活动过程与立法解释程序内容的构成标准两个方面入手,以立法解释程序内容的构成标准为尺度来对立法解释活动过程的各个步骤进行筛选,是界定立法解释程序内容与范围的合理与有效方法

| Abstract: | Cleaning up the content and scope of the legislative interpretation is the premise to study and consummate the legislative interpretation procedure.Simultaneously it is one of the basic questions about the legislative interpretation procedure.To analyze the boundary of the legislative interpretation procedure's content and scope should start with two aspects:the legislative interpretation activity process and the legislative interpretation procedure's content constitution standard.Taking the legislative interpretation procedure's content constitution standard as the criterion to sift the procedure of the legislative interpretation activity process is the reasonable and effective method to make the boundary of the legislative interpretation procedure's content and scope. |
