法律是非物质文化遗产保护的重要手段。对非物质文化遗产保护工作的有序开展具有重要意义。但是目前已出台的地方立法中对非物质文化遗产立法保护需要解决的关键问题依然没有明确的认知，立法中也未有相应的设计。因而，需要明晰非物质文化遗产法律保护中的亟须重点解决的问题，以便今后在制定相应法律规范的立法过程中可以做到有的放矢。
