立法法理学的独特性及其主要研究对象

立法法理学即是从法理学的视角来研究立法问题,它是当代西方法理学新兴的一门分支学科.作为一门新兴学科,立法法理学并不为国内很多学者熟知,它的独特性及重要性也并不为很多学者认同.到目前为止,其学科定位还较有争议,主要研究对象和研究方法也没有完善起来.分析立法法理学不同于其他学科的自身独特性,并且希望在此基础上建构起立法法理学的主要研究框架,以引起学者们对立法法理学的关注与探讨.

The uniqueness and main research objects of legisprudence

Legisprudence, a jurisprudential study of legislation, is a new branch of contemporary western jurisprudence. As a newly - emerging subject, it isn＇ t well known by domestic scholars, nor are its uniqueness and significance recognized by many scholars. So far, there are still controversies in the orientation of the subject, and the main research objects and methods remain unimproved. Due to the distinct uniqueness of legisprudence from other disciplines, this paper intends to construct a research framework of legisprudence so as to promote scholars＇ attention to and discussion of legisprudence.
