犯罪本质与本质特征新界说

由于没有先弄清犯罪本质与犯罪本质特征的关系,故国内刑法学至今还在回避犯罪本质问题,对犯罪本质特征也没有提出令人信服的看法。从哲学的角度来看,犯罪本质是犯罪的内在规定性,决定着犯罪本质特征,而犯罪本质特征则是犯罪本质的外在体现;立于犯罪构成的内在联系及其结构和刑罚的目的与功能,犯罪本质应是犯罪人之于社会秩序的极端蔑视态度,而立于犯罪与一般违法行为的区别,犯罪本质特征应是应受刑罚惩罚性。

Reconsideration on Criminal Essence and Essential Feature of Crime

Because the relationship between criminal essence and essential feature of crime has not been made clear,the issue of criminal essence itself is avoided,and all the views on essential feature of crime proposed are not convincible in civil theory of criminal law.From philosophy,criminal essence is the internal aspect which decides essential feature of crime,while essential feature of crime embodies criminal essence.From the internal connection and structure of constitution of crime and goal and function of punishment,criminal essence should be an offender's attitude to social order,while from the difference between crime and general violation against law,essential feature of crime should be punitive.
