| 摘 要： | 在区分公法行为与私法行为的基础之上，对学界关于房地产登记行为的性质的主流观点“私法行为说”进行批驳，明确房地产登记行为的公法行为性质，并进一步论证房地产登记行为的行政行为性质，阐明正确界定这一性质的重要现实意义。

| Abstract: | Based on the distinction between private behavior and public behavior ,the article refutes the mainstream academic view "view of private behavior" ,and makes clear that the registration of real estate has public nature. The article also further demonstrates that the real estate registration has administrative action nature,clarifying the important realistic significance to define the nature of the real estate registration correctly. |
