| 摘 要： | 公正是司法的价值取向,但由于实体真实与程序正当、公共利益与个人利益、法内因素与法外因素、规划正义与社会正义等因素的制约,司法公正总是呈不平衡状态。文章通过论述实体真实与程序正当、公共与私人利益之间的不平衡,阐述了司法公正的不平衡规律。

| Abstract: | Fair is the value orientation of judicatory, but because of the restriction from the factors, such as justice by program and of society, the judicial fair always keeps in unbalance. By treatise of the unbalance between the entity truth and proper procedure, public and private benefits, the essay elaborates the unbalanced rule of judicial regulations. |
