河南省取消法律援助事项范围限制的可行性分析

法律援助事项范围的限制将一些需要法律援助的主体排除在外，这与“应援尽援”要求不符。实践中，河南省一些辖市取消法律援助事项范围的限制取得了良好的社会效果。取消法律援助事项范围限制不论是理论上还是实践上，都是可行的、合理的。由此引发的司法资源短缺、法律援助欺诈等问题，可通过进一步完善法律援助标准立法、设立公示制度、设置案情审查标准、确定不予援助案件范围、建立援助案件等级优先制等来解决。
