| 摘 要： | 随着司法实践的深入开展,量刑畸轻畸重现象有所缓和,但量刑偏轻偏重现象仍然较为普遍。有必要对造成这种司法监督现状的原因进行深入分析,重构法律监督理念,并正确处理好这种检察权与审判权以及公诉权能和监督权能的关系。
