| 摘 要： | 我国已经初步形成海洋法律法规的系列化和系统化,但与全球化大背景之下的新一轮国际海洋世界＂圈海＂竞争的现实相比较,我国在海洋法建设中仍然存在着一些亟待提速、提高和提升的地方。为此,本文梳理和反思了我国海洋法的体例、体系和机理的现状并展望了它的发展趋势,从而得出了必须反思概念、理念和功能,必须面对海洋事业、问题、矛盾、争端和冲突,必须加强和健全海洋法律、法规和规章的体例、体系和体制。

| Abstract: | China has formed a series of systematic marine laws and regulations,but under the background of globalization,compared to the new round of enclosure in the international marine world,there lies the urgency to speed,improve the construction of the marine laws and regulations.Therefore,focusing on and reflecting the current situation of China’s laws of the sea,systems and mechanisms,and looking forward to the future development trend,this article reaches the conclusion that we must reflect on concepts,ideas and functions,face the marine enterprise,problems,conflicts,disputes and conflict,and strengthen and improve the marine laws,regulations,rulings,system and institutions. |
