| 摘 要： | 立足于主客观相统一原则在我国当前刑事司法适用中实际存在的问题,首先,在以"单一罪过"原则揭开复合罪过的面纱,指出异质罪过应当定不同罪名;其次,在牵连犯两罪刑罚幅度不分伯仲时,倡导以行为人犯罪目的为支配导向的定罪原则;复次,以"浮动客体"概念厘清诸如抢劫罪等犯罪的既未遂形态及其刑罚的合理选择;最后,强调了在现实的刑事司法实践中,证明标准不应是铁板一块,而应当具有纵向与横向的层次性。
