| 摘 要： | "在履行公务期间"是叛逃罪的时间限定要件,也是《刑法》第109条第1款与第2款两种叛逃行为的重要区别界限。作为叛逃罪的必要构成要件,"擅离岗位"不仅限于"未经允许或未得到批准",即使"经允许或得到批准"而"离岗",如果超限仍可构成"擅离岗位"。在理解"叛逃"行为含义时,应当将"投靠境外的组织或机构"排除在其基本内容或者构成要素之外。在《刑法修正案(八)》对叛逃罪修改之后,不必要具有"危害中华人民共和国国家安全的行为",而单纯具有"叛逃境外或者在境外叛逃"的行为,即可构成叛逃罪。
