我国集体合同法律制度实践的困境分析

摘    要:我国集体合同法律制度实践存在签订率低、覆盖面窄、内容空洞、履行缺乏强制性、争议处理程序欠缺等问题,原因在于:工会组织的独立性、政府的中立性以及雇主组织履约、缔约的内驱力和强制力不足,使得三方机制受损。为了完善我国的集体合同制度,增强其时效性,我们应强化工会组织的独立性、政府的中立性以及雇主缔约、履约的内驱力和强制力。

Abstract:There are low signing rate,narrow coverage,lack of concrete contents,lack of mandatory enforcement,deficiency of dispute handling process and other problems when collective contract law in China has been put into practice.The causes are deficiency of independence of trade union,lack of impartiality of government and shortage of drive and push from employers,and hence harm the tripartite system.In order to optimize the collective contract law and elongate its effective time,we should correspondingly strengthen the parties mentioned above.
