俄罗斯20世纪90年代法学思潮述评

俄罗斯 90年代的法学思潮 ,集中表现在对法的理解上 ,伴随着前苏联改革及其解体后俄罗斯的社会转型展开和演进。总体上说 ,俄罗斯法学界在对待法的问题上 ,主要有三种思潮 :自然法 (道德 )的、社会学的和规范主义的。前期注重法的内容 ,忽视法的形式 ,夸大国家权力的消极方面 ,强调法与法律的区别 ;通过法与国家关系的探讨和实践总结 ,后期兼顾法的内容与形式 ,正视国家作用的观点成为主流。文章拟从 90年代前期和后期俄罗斯法学研究的不同侧重来揭示这一时期的法学思潮。

A Survey of Legal Ideas in the 90'' s of the 20th century in Russia

Russian legal ideas in the 90's are focally embodied in the understanding of law accompanying the development and evolution of social transition in Russia after the reforms in the former Soviet Union and its dissolution. Generally, Russian academic circles of law are divided on the issue of law into three categories: naturalist (ethical), sociological, and normative. In the earlier stage focus was on the content of law rather than the forms overstating the negative aspects of state power and the distinctions between law and statutes while in the later stage, through discussions and summaries of the relationship between law and state integrating both content and form of law, perspective of correctly viewing the role of the state has become the mainstream. This article proposes to reveal the legal ideas during this stage from different perspectives of legal research in Russia in the earlier and later stages of the 90's.
