农民工维权中的"自助行为"及其引导

“自助行为”是解决纠纷或冲突的一种有效的解决方式，但其行使是有一定限度的，并不是任何情形下都可使用。农民工维权中的“自助行为”主要体现为以极端甚或非法的手段试图救济自己受损的权利，而其结果常常事与愿违，不自觉中助成了自己由受害人向加害人的转化。把自己由权利的合法拥有者，推向了违法者，甚至犯罪人的位置。农民工维权中的“自助行为”多属一种无奈的选择。他们的“自助”行为富有夸张性，更多地具有引起相关部门或组织关注的意味。不要总把农民工维权的“尴尬”归结为法律意识的问题，其实更为深层的问题在于公权力或相关组织能否为其提供便捷而有效的救济途径。

On Self-service Behaviour of Peasant-workers and Proper Guiding in Right-defending

Although self-service behaviour is one of the effective methods of resolution,it can only be applied to special conditions. The self-behaviour of peasant-workers often presented extremely and illegally. Opposed to their original intention,as a result, they turn themself to the position of defender due to their illegal or criminal behaviour. In fact,the self-service behaviour of peasant-workers in right-defending is a helpless choice, and the main purpose of their extravagant action is only to arouse attention of the government or other institutions. We should not simply regard this self-service behaviour as lack of legal consciousness, and the truth may exists in whether public power or related institutions can provide an efficient and effective relief channel for them.
