| 摘 要： | 传统民事责任理论以行为人的行为具有违法性为要件,环境侵权行为具有相当程度的价值正当性和社会有用性,很难认定其具有违法性。因此,环境侵权行为又给传统行为违法性理论提出了挑战。根据环境侵权行为的不同类型,并借鉴国外的相关立法,可以得出在一般生活型环境侵权行为中仍应以违法性作为其要件。

| Abstract: | The traditional civil liability theory is based on the illegal act of the infringer.Environmental infringement act has the value of justice and social practicality to some extent,so it is difficult to determine its illegality.Then it provokes a challenge to the traditional illegal theory.According to the types of environmental infringement and in view of foreign relative legislature, in general life-style environmental infringement act,illegality is still its main factor. |
