对中国封建社会刑罚适用的认识与思考

中国封建社会的刑罚 ,由于其相同性质的社会制度 ,不同朝代可以传抄、沿用。而社会主义必须彻底废除旧刑罚 ,创立新刑罚。但是 ,不管旧刑罚还是新刑罚 ,作为法律文化 ,它们之间必然有着历史的联系。社会主义的刑罚适用在法律文化方面对封建社会刑罚适用有批判地继承和创新 ;社会主义“法德并举”的治国方略对封建社会“刑礼并用”治国方略有批判地继承和创新 ;封建社会严惩贪官污吏为我们反对腐败提供了历史经验 ;封建社会对死刑的慎用对我国改革死型制度也有所启迪

Understanding and Considering Application of Criminal Punishment of the Feudal Society of China

Because of the social system with the same nature the criminal punishments of feudal society of China could be copied and continue to be used is different dynasties but in society of socialism old punishment must be eliminated and new punishment must be established.However both old punishment and new punishment,as cultures of laws,contain the inevitable historical relation between the two.The criminal punishment of socialism is suitable for the culture of laws which critically inherited punishment of feudal societies and made innovation.The socialist strategy of "governing the country by the rules of law and virtue critically inherited the strategy of "governing the country by the rules of punishment and the proprieties" of feudal society and made innovation.The feudal society fiercely punished corrupt officials,which provided historical experience for our anti-corruption;They implemented death sentence carefully,which also provided some enlightenment for us to reform the system of death penalty.
