| 摘 要： | 受机械自然论影响,传统能源法只关注能源供应安全,忽略了对外部性的管理,从而导致严重的生态和社会问题.生态伦理的兴起要求改变传统的能源-经济模式与能源法律政策.世界各国能源法开始以可持续能源为法律目标和价值取向的变革.能源法生态化变革的基本制度进路是将"外部成本内部化",并尽量寻求成本有效的途径.要逐步促进能源法的生态化,既需要限制或扩展财产权,也需要赋予公众参与能源开发利用的权利.
