| 摘 要： | 行政指导是一种新型的、柔性的行政行为,用价值分析的方法分析其运行过程发现,行政指导在自由、效率和正义等方面极有可能发生背离其既定价值的倾向。确定行政指导双向维度的理论基础可以指引行政相对人趋利避害,而通过法治对其进行控制可以保证行政指导有效实施、运行和发挥应有的效用。

| Abstract: | Administrative guidance is a new-type and flexible administrative behavior,though anglicizing its operation course,it is probable that administrative guidance has an inclination which will deviate from its set value on freedom,efficiency and justice,etc.Confirming its theoretical foundation of two-way dimension can direct administrative opposite party to go after profits and avoid disadvantages,and controlling it by law-based ruling will guarantee that administrative guidance implements,operates effectively and brings into play its due greatest utility. |
