| 摘 要： | 代议制理论的主要缺憾,是其理论设计的民主形式不能全面满足实现人民主权的根本目标,人类政治实践也证明了仅靠代议制民主及三权分立并不能完全实现人民主权的崇高理想,应当以人民主权原则为基准扬弃代议制及三权分立理论,建构"以权力制约权力"和"以权利制约权力"的双重控权方式,完善制约国家权力的公民宪法权利体系,以期更加全面地实现人民主权.
