| 摘 要： | 我国现行法律将民间文学艺术纳入著作权法体系予以保护。然而，民间文学艺术不同于著作权法意义的“作品”，其在权利主体、保护期限等方面均与著作权制度存在冲突，著作权法对民间文学艺术的保护面临不可回避的局限与困惑。笔者认为，我国应当制定民间文学艺术保护特别法，文章对特别法律制度的构建提出思考和建议。

| Abstract: | Our country＇s present law brings folk literature and art into copyright law system to protect. However ,folk literature and art is different from the works in copyright law, it conflicts with the copyright system in aspect to the subject of rights and protection deadline,copyright law existances unavoidable limitations in folk lore protection. The author believed, our country should formulate special law to protect folklore, this article proposes helpful suggestions to the special legal system. |
