论黑社会性质组织的合法性问题

和政治体系及常规性社会组织一样,黑社会性质组织也有个合法性问题。不过,由于受其组织性质的制约,其合法性的实质是在形式上满足社会主流价值规范的要求,获得不良群体或弱势群体及其成员、以及少数对社会主流价值规范缺乏认同感的官员的认可与支持。黑社会性质组织的合法性有三个基础:符合部分社会成员的某些利益需求;在形式主义和地方主义价值取向下,表现出与某些社会主要价值观的一致性;暴力恐吓。这三个基础实际上反映了黑社会性质组织与社会的关系。

Legitimacy of Organized-Crime Groups

Just as political institutions and regular social organizations, organized-crime groups also face the problem of legitimacy. But, due to their nature of organized crime, its legitimacy is in essence to meet the value requirements of the mainstream society and obtain the approval and support of the bad and weak social groups and the few officials not identifying with the mainstream values. The legitimacy of organized-crime groups has three foundations: catering to the interests of some members of the society, conforming to some mainstream values with help of formalism and local protectionism, and threatening by use of force. These three foundations reflect the groups' relationship with the society.
