摘    要:用人单位内部劳动规则的性质一直存在争议,主要有契约(或合同)说、法规说、事实说、根据二分说、集体合意说、格式条款说等。各种观点的持有者,往往从某一方面的属性来探究内部劳动规则的性质,没有从整体上、全局上进行综合分析,因而不能准确反映内部劳动规则的本质特征,带有很大的片面性。比较分析内部劳动规则与集体合同的主体、内容、制定程序和效力等,可以看出,内部劳动规则具有集体合同的属性,因此可将内部劳动规则视作集体合同的一种或一部分。

Abstract:The nature of employer's internal labor rules has been in debate, and six theories have thus been put forward: of contract, of regulations, of fact, of dichotomy, of collective consensual, and of format terms. These theories are largely one-sided and cannot reflect the essential eharaeteristles of internal labor rules. By comparing internal labor rules with collective contract from four dimensions, i.e. subject, content, procedures, and effectiveness, this article holds that internal labor rules have the attributes of collective contract, and can be taken as collective contract or a part of collective contract.
