| 摘 要： | 1995年的《劳动法》中并没有服务期的相关规定,2008年1月1日起施行的《中华人民共和国劳动合同法》提出了服务期的概念,并对此予以规范,但适用前提的规定过于单一,对违反服务期条款的法律后果规定也不明确,与社会发展不相协调,因此,亟需完善。

| Abstract: | There is no relevant provision on service period in the Labor I.aw of 1995. The Labor Contracc I.aw of the People＇s Republic of China, which came into force from January 1 , 2008, defines service period and makes clear some provisions, However, the premise of the provisions is so simplc and the legal conse- quence of the violation of service period is so vague that the provisions have failed to go along with social developmcnt and they need perfecting. |
