一个关于产权保护和实施的文献述评

国家权力与产权的关系,对于转轨经济尤其重要,而国内外在这一领域的研究也已经积累了丰富的文献。本文试图从产权的保护和实施的角度对相关研究进行梳理。就产权的保护和实施而言,这些研究注重产权主体行动所产生的成本,成本与收益的比较决定了产权的结构。笔者将其大致分为第三方实施和自我实施理论,第三方实施强调诸如议会、行会等第三方组织对国家权力的约束,而自我实施则倾向于把产权保护看做国家有意识的行为。笔者对以上理论分别进行了评述,并提出了进一步研究的设想。

A Documentary review on protection and implementation of property rights

The relationship between state righ ts and property rights are of special importance for the transforming economy.Studies in th is field both domestic and abroad hav e accumulated rich documents.This paper tries to analyze these doc uments from the perspective of prote ction and implementation of property rights.These studies put emphasis o n the cost of property rights,which w ith proceeds determines the struc-ture of property rights.The author d ivides them into the third body' s implementation theory and oneself im-plementation theory.The former emp hasizes restriction of the third bod y,such as parliament,guild on state rights,while the latter tends to regard protection of property rights as conscious behavior of state.
