WTO反倾销协定与我国反倾销法的完善

近年来 ,倾销与反倾销的双重冲击与考验 ,给我国对外贸易造成了很大损失。在我国成为WTO成员之际 ,研究WTO反倾销规则 ,进一步完善我国反倾销立法 ,是摆在我们面前的急切任务。WTO《反倾销协定》的内容基本上是恰当的 ,但仍存有不足。检讨我国反倾销立法 ,也存在立法层次低、效力差、有些规定过于笼统、缺少司法审查制度等缺陷 ,这就需要在即将出台的的《反倾销法》增加具体的反规避条款及完善司法审查制度等

WTO's Anti-Dumping Agreement and the Perfecting of China's Anti-Dumping Legislation

In recent years, both the dumping and anti dumping matters have led to much loss in China's foreign trade. Researching on WTO's anti dumping rules and perfecting China's anti-dumping legislation is an imperative task we are confronted with on the very time when China become a member of WTO. The Anti-Dumping Agreement is basically appropriate, yet it has deficiencies. There are also some defects in China's anti-dumping law-making, such as the low legislature level, the unconfined nature of some provisions, the lack of judiciary investigation system. What we need earnestly now is that we should promulgate an improved anti dumping law as soon as possible.
