| 摘 要： | 目前关于国家索赔海洋生态损害的赔偿责任问题主要包括归责原则、构成要件、损害范围和赔偿范围、赔偿责任限制等四个方面。国家索赔海洋生态损害的赔偿责任应对破坏海洋资源造成的海洋生态损害和因海洋环境污染造成的海洋生态损害进行区别对待而采用二元化的归责原则与构成要件,目前我国在赔偿范围方面还很不完善,应该借鉴国际经验,将来制定政策或立法时,进一步完善我国的赔偿范围和有关责任限制的规定。
