后金融危机时代的金融法制变革与重构

目前,尚难以准确地界定金融危机与后金融危机时期的具体时点,但后金融危机时期制度对策本身所带有的阶段性和局限性特征则清晰可辨。在承认这一客观现象的基础上,一方面应当认识到当下诸多金融法制变革大多仅具有改良属性;另一方面须看到这些改良中所蕴含的真正制度需求。因而,金融法制重构的核心在于如何实现新型利益衡平机制,如何理顺部门法在金融产品规制方面的关系,如何有效保护金融消费者的合法权益。否则今天的改革难免陷入矫枉过正的局面。
