电话营销的内涵及其法律规制的正当性

摘    要:从介绍电话营销的起源入手,探讨电话营销的内涵,进而分析电话营销法律规制的正当性基础。为了防止营销者随意拨打消费者的电话,保障电话用户选择接听电话的自由权利,国家应当从法律上加强对电话营销行为的管制。保护公共利益和电话用户的隐私权以及防止电话营销者转嫁经营成本等,构成了电话营销法律规制的正当性基础。
