| 摘 要： | 在揭示利益分析方法在美国、德国的冲突法实践中所获不同归宿的基础上，结合对中国法律制度特殊性的理解，就该法在未来中国冲突法中的可能归宿进行了探讨，指出其基本定位是一方面它将以传统冲突规则为依托而存在，另一方面则又必须是以法定的形式出现，由立法来支撑，指引法官在有限的范围内行使自由裁量权。

| Abstract: | It reveals the fate of interest analysis method in American and German Conflicts Laws, on the basis of which the paper explores the would-be position of this method in China＇s Conflicts Law, referring to the peculiar understanding of Chinese legal system. It points out that the interest analysis method will basically depend on the traditional conflict rules for existence; on the other hand, it will embody the legal form, directing the judgers to make their discretions. |
