论基层法官司法审判能力的提升——以社区医疗纠纷的裁判为视角

解决纠纷是基层法官的基本职业定位,纠纷解决的有效性取决于基层法官司法能力的高低,基层法官准确认定案件事实的能力、恰当适用法律的能力都直接影响着纠纷当事人对裁判结果的信服度和公众对司法权威的公信度,进而影响到判决的执行效果。从基层法官司法能力中的审判能力提升为着眼点,从审判时的司法经验、司法技巧及标准规范三个方面的应用进行探讨,同时论述了司法理念对司法审判的影响作用,总结得出基层法官在司法审判时应将司法经验与法律规则相结合,灵活运用各种发现案件事实的司法技巧,辩证地对待裁判的标准规范,并将先进科学的司法理念贯穿于整个司法审判中。

The Promotion of the Trial Judges' Trial Capacity

Resolving disputes is the trial judges＇ basic role, and the judicial capacity depends on the capacity of grass- roots judges＂ judicature, the ability to determine the case facts and apply accurately the concerned law, which influences people＇s faith to the law and the effect of the judgment execution. The paper, aiming at promoting judges＂ judgment abili- ty, discusses three aspects like Judicial experience, Judicial skills and Standard specification and how judicial ideas affect judgment. The conclusion is that judges are supposed to combine experience and laws, apply flexibly various ways to in- vestigate facts, have a correct attitude to rules and standards and apply the advanced scientific iudicial ideas though the whole procedure.
