论我国合同法诚信原则的完善

在当代中国经济实力逐渐增强的今天,各种商品服务的交易数量与质量都逐日提高,人们法律意识的增强促使合同法发挥着愈加重要的作用,合同法的规定是否完善在很大程度上影响着交易能否有序高效地进行。我国新合同法领先于世界水平,其规范内容与所发挥的作用无可替代。从合同法中诚信原则在该法中的体现出发,将诚实信用原则细化于规则之中,体现了该法围绕此原则形成的完整体系,也正是该法的亮点所在。但法律并不能面面俱到,便产生了法官自由裁量权与法律原则抽象性的冲突,因而对局限性的完善显得确有必要。

On the Improvement of the Honesty Reputation Principle in Contract Law of China

With the strengthening in contemporary Chinese economy, the quality and quantity of various goods and services trade has increased day by day, and meanwhile the enhancement of people＇s legal awareness promotes the function of the contract law. The purpose of this paper is to highlight the fact that the new contract law of China is more advanced in the world, as its content standards and function are irreplaceable. This paper starts from the reflection of the honesty and credit principle in the law and integrates it in specific regulations, revealing that the law has formed a complete system, which is the highlight of the law. But the discretion of judges and the abstract of principles are conflicted, which makes it necessary to conquer the limitation.
