论强制执行竞合及其解决

强制执行竞合是强制执行实践中普遍存在的一种现象,同时也是强制执行制度的一个重要的理论问题。本文指出,我国在解决强制执行竞合问题上存在着法律规定上的漏洞和缺陷。解决强制执行竞合问题,应当从强制执行竞合的基本理论出发,结合我国的实际情况,探索和研究我国应遵循的原则。同时,还应注意协调我国法律规定在强制执行清偿原则、扣押措施以及保全执行与终局执行等问题上的矛盾和冲突。 

On the Enforcement Contest and Its Solution

Enforcement contest is a general phenomenon in enforcement practice,as well as an important theoretical problem in enforcement.This article points out the flaws and drawbacks in solving the problems of enforcement contest.The solution to that problem should be based on the basic theory and combined with in situation in our contry.Meanwhile,we should pay attention to the problem of coordinating different enforcement regulations.
