| 摘 要： | 基于教唆犯性质的二重性说,教唆犯的着手不以被教唆者的着手为转移,只要教唆犯开始以言词或者其他方法进行教唆,就应视为教唆犯已经着手实行犯罪,但教唆犯的预备犯一般情况下不宜认定为犯罪;教唆犯存在未遂形态,但要严格区别未遂教唆与独立教唆犯,正确理解刑法第29条第2款并在立法上加以修改完善;教唆犯的中止的成立不仅要自动放弃本人的教唆行为,还必须以有效制止被教唆者的犯罪行为为必要。

| Abstract: | Based on the double-foldedness theory,researchers hold that the abettor starts with words or by other means the process of abetting, but the preparation period should not be regarded as the abettor's beginning to violate laws.There should be a sate of abetting abortiveness,but the uncompleted abetting and independent abetting should be clearly differentiated.The abortion of his abetting is far from enough except that he prevents the others' criminal conduct. |
