| 摘 要： | 精神病人在住院治疗期间发生的伤害事件,可以分为可防范的冲动性伤害行为和不可防范的冲动性伤害行为。精神病人伤害事件,并不是只要是在精神病院发生的,不管精神病院有无过错,都由精神病院承担赔偿责任,而应当由精神病院和监护人等分别承担赔偿责任。

| Abstract: | Injurious incidents happen to mental patients during the treatment period in insane asylum are divided into impulse injurious behavior that can be prevented and impulse injurious behavior that can't be prevented. The mental patient injurious incidents taking place in the insane asylum should be in charge of by insane asylum and guardian, etc. separately. |
