| 摘 要： | 我国的农村改革与制度变迁基本上是在缺乏宪法规范支持的背景下实施的。为了消除人们对它的合宪性产生的质疑，在分析我国农村改革与制度变迁的合宪性时，必须坚持合宪性推定原则特别是由它派生出来的政治问题不审查原则。

| Abstract: | China＇ s rural reform and system change is basically carried out under the background lacking in the support of constitutional rules. In order to eliminate people＇ s questioning constitutionality, the principle of constitutionality presumption, especially the principles of not reviewing political problems deriving from it, should be insisted when the analysis of constitutionality of China＇ s rural reform and institutional change is conducted. |
